The article discusses a recent case heard by the United States Court of Appeals for the Federal Circuit (CAFC), Cancer Research Technology, Ltd. v. Barr Laboratories (CRT v. Barr). Carlin and Davis summarize the current state of the law on prosecution laches in view of CRT v. Barr and provide guidelines for practitioners needing to balance client needs with equitable obligations of timely prosecution.
